    Jakobs aborda en esta obra el problema de la autodescripción de la ciencia del Derecho como humanística debido a la connotación positiva del adjetivo. Para el autor no pueden formularse contenidos humanísticos inamovibles en la ciencia del Derecho debido a que el Derecho moderno es un Derecho positivo. Sin embargo, opina que cuando la ciencia del Derecho forma a la sociedad en la comprensión del mismo y de ella misma, deja de ser una mera técnica jurídica para convertirse en una disciplina humanística.
